In regime di affido condiviso, entrambi i genitori, quando hanno il figli minorenni con loro, possono portarli dove vogliono, anche in vacanza ed anche all’estero ed hanno solo l’obbligo di informare l’altro genitore del luogo dove andranno.
Secondo la Corte di Cassazione sarà, casomai, l’altro genitore che, se vuole opporsi, dovrà fare istanza al giudice affinchè vieti la vacanza, se vi sono ragioni oggettive o soggettive che la sconsigliano (epidemie, malattia del figlio etc…).
E’ bene ricordare che l’assegno di contributo al mantenimento per i figli va versato anche durante le vacanze estive in cui i figli abitano con il genitore obbligato, perché l’assegno mensile è considerato una delle dodici rate in cui è suddiviso il costo annuo di ciascun figlio e deve essere utilizzato per le sue spese abituali ed ordinarie (abbigliamento, cancelleria, attività ricreative abituali, medicinali da banco etc…) e quindi va versato ogni mese.

SEPARATED PARENT: RULES FOR HOLIDAYS WITH CHILDREN
Under shared custody, both parents, when they have minor children with them, can take them wherever they want, even on vacation and even abroad and only have the obligation to inform the other parent of the place where they will go.
According to the Corte di Cassazione, it will be, if anything, the other parent who, if he wants to oppose, will have to apply to the judge to prohibit the holiday, if there are objective or subjective reasons that advise against it (epidemics, illness of the child, etc.).
It is good to remember that the child support allowance must also be paid during the summer holidays in which the children live with the obligated parent, because the monthly allowance is considered one of the twelve installments into which the annual cost of each child is divided and must be used for his or her usual and ordinary expenses (clothing, stationery, usual leisure activities, medicines etc…) and therefore must be paid every month.
